The licensee shall not transfer or assign all or any portion of its interest in any license granted pursuant to this chapter without prior written authorization of the City Manager, which authorization shall not be unreasonably withheld, conditioned, delayed or denied. For purposes of this section, a merger or corporate reorganization shall not be deemed a transfer or assignment.
1. The City Manager shall promptly send by certified mail with return receipt requested a written notice advising each prospective licensee or licensee of action by the City Manager in granting or denying an application for a license.
2. Within three (3) business days after receipt of any such notice from the City Manager, an aggrieved prospective licensee or licensee shall have the right to a hearing before the Council by filing a written appeal with the City Manager specifying the reasons therefor. At least ten (10) days prior to the date of the Council hearing, the City Manager shall send written notice of same to the appellant by certified mail with return receipt requested. At the Council hearing, the appellant may be represented by legal counsel, may call witnesses and present evidence on his or her behalf, and may cross-examine witnesses.
1. All cables, wires and conduits in connection with any communications system shall be placed underground, except where above ground connection to buildings or other locations above ground is reasonably necessary. Such above ground connection shall be by means of poles located, as far as reasonably practicable, within alleys.
2. Cables, wires and conduits in connection with any communications system may be placed either underground or on poles above ground. No such poles shall be installed or erected, and no license or permit for same shall be issued, until the building inspector has approved the proposed location, construction and pole heights.
3. Communications systems shall be constructed underground anywhere in the City where by ordinance or other arrangements, other communication systems are required to be placed underground. They shall also be placed underground in any area of the City where arrangements cannot be made to place the communications system contemplated by this chapter on existing utility poles.
Nothing in this chapter shall be construed as an acquiescence in, or ratification of, the occupation of any of the public right-of-way or public places of the City by any person now occupying the same without legal right, nor shall this chapter be construed as conferring the right to occupy any of the public right-of-way or public places of the City upon any such person now illegally or without authority occupying the same.
