(A) Any violator who has received a notice of violation under § 71.01 may answer the charge before the town paying a civil penalty in an amount as set by the Board from time to time.
(B) Unless otherwise stated, a fine levied under this section shall be a maximum in an amount as set by the Board, from time to time, per day with each day constituting a separate and distinct violation. At the discretion of the issuing officer, a civil penalty may be assessed, payable to the Town Finance Department, and recoverable by the town in a civil action by failure to pay within 30 days, pursuant to G.S. § 160A-175(c). Otherwise, the violation shall be an infraction with a maximum fine in an amount as set by the Board from time to time, and jurisdiction shall be proper in the General Court of Justice for the county.
(C) The town shall have the right to abate any violation of § 71.01 through injunction pursuant to G.S. § 160A-175(e), and shall hold the property owner (real and personal) liable for all costs associated with a remedy, to include a reasonable attorney's fee, and the fines and costs shall be assessable as a lien on the property.
