§ 96.020 CANOPIES AND OVERHANGS.
   (A)   Any provision to the contrary in this code notwithstanding, by special permit a party may obtain permission to construct a canopy or overhang onto a public street or sidewalk. The party desiring such permit shall make a written application stating the purpose and details of such canopy or overhang, including a drawing or sketch to scale of the sidewalk and/or street to be effected; the dimensions thereof, the materials of which it is to be constructed; and the purpose thereof. Such application shall state in detail the manner of construction. The City Manager shall have the authority to issue the permit upon determining that such construction will in no way unreasonably effect the flow of traffic on the street and/or sidewalk; shall not unreasonably interfere with visibility; and will be properly constructed.
   (B)   In the event that the overhang or canopy is improperly maintained, the City Manager shall, upon giving ten days’ notice in writing to rectify the situation and upon failure of the then owner or party in possession to repair or remove the canopy or overhang, cause the canopy or overhang to be removed at the cost of the then possessor or owner.
