§ 95.25 BOATING.
   (A)   Boating of any kind or character is prohibited in that portion of the reservoir designated as Zone A.
   (B)   Boating in Zones B, C and D is subject to the following restrictions.
      (1)    All operators of boats are subject to the Governor Bond Lake summary of regulations and fees published by the city annually.
      (2)   The business of renting boats for hire or carrying passengers for hire on the reservoir is prohibited, except as may be authorized by concession granted by the city, but the provisions of this subchapter shall apply to all boats and craft permitted by special concession; and all such concession boats or craft shall be subject to inspection from time to time during their period of operations on the reservoir. Any such boats or craft failing to have approved life preservers in place as when licensed or otherwise failing to pass inspection shall be made to comply with this subchapter before further operation. No individual operator or employee or any person operating any boat carrying passengers for hire shall be permitted to operate such boat unless he or she is physically fit for such duty, has adequate knowledge of the boat mechanism, is familiar with the ordinance, rules and regulations for the operation of boats on the reservoir and with the commonly approved safety regulations and measures to be used in case of accident or emergency, including instruction of passengers in the use of safety equipment and their conduct in case of emergency. Each operator or employee shall at all times be subject to examination and approval by the city as to such qualifications; and any determination by the city as to such qualifications shall be conclusive.
   (C)   (1)   Definitions. For the purpose of this subsection (C), the following definitions shall apply unless the context clearly indicates or requires a different meaning.
         MOTORBOAT. Any vessel propelled by machine and whether or not machinery is the principal source of propellation, but does not include a vessel which has a valid maritime marine document issued by the Bureau of Customs in the U.S. Government or any Federal Agency’s successor thereto.
         OPERATE. Navigate or otherwise use a motorboat or vessel.
      (2)   Age of operator.
         (a)   No person under ten years of age may operate a motorboat.
         (b)   Persons at least ten years of age and less than 12 years of age may operate a motorboat only if they are accompanied on the motorboat and under the direct control of a parent or guardian, or a person at least 18 years of age designated by a parent or guardian.
         (c)   Persons at least 12 years of age and less than 15 years of age may operate a motorboat only if:
            1.   They are accompanied on the motorboat and under the direct control of a parent or guardian;
            2.   A person at least 18 years of age designated by a parent or guardian; or
            3.   Such motorboat operator is in possession of a boating safety certificate issued by the Department of Natural Resources, Division of Education or a valid certificate issued by another state, a province of the Dominion of Canada, the U.S. Coast Guard Auxiliary or the U.S. Power Squadron.
