§ 153.1367 JUNKYARDS AND AUTOMOBILE GRAVEYARDS.
   (A)   Purpose and findings. This section establishes regulations for junkyards and automobile graveyards to ensure that neighborhoods and economic development opportunities are protected, consistent with state law.
   (B)   Applicability. This section applies to any junkyard or automobile graveyard.
   (C)   Conditional use permit.
      (1)   Junkyards and automobile graveyards shall be located at least 500 feet from any dwelling unit or residential zoning district.
      (2)   Any new automobile graveyard or junkyard and substantial intensification of an existing junkyard or automobile graveyard requires approval of a CUP.
   (D)   Standards for conditional use permit.
      (1)   New facilities. A new junkyard or automobile graveyard may be established only in an “IH” (Industrial Heavy) Zoning District.
      (2)   Definition. A NEW JUNKYARD OR AUTOMOBILE GRAVEYARD shall mean any facility, structure or land-use storage of used scrap salvage materials, including, but not limited to, shredding, milling, grinding, baling or packing equipment for the handling of scrap, salvage materials, or used materials.
      (3)   Standards.
         (a)   No material shall be placed in any automobile graveyard or junkyard in such a manner that it is capable of being transferred out of the automobile graveyard or junkyard by wind, water or other natural causes. The loose storage of paper and the spilling of flammable or other liquids into streams or sewers are prohibited.
         (b)   All materials shall be stored in such a manner as to prevent the breeding or harboring of rats, insects or other vermin. Where necessary, this shall be accomplished by enclosure in containers, raising of materials above the ground, separation of types of materials, prevention of the collection of stagnant water, extermination procedures or other means. Professional monthly exterminating services are required, and a log indicating the dates and findings of such professional services shall be maintained on the premises.
         (c)   A junkyard or automobile graveyard shall include a Type E buffer yard (see §§ 153.1120 through 153.1130 of this chapter) along all property lines abutting a public street or any zoning district other than “IH” (Industrial Heavy).
         (d)   All other standards for CUPs contained in §§ 153.0700 through 153.0709 of this chapter.
      (4)   Substantial intensification of an existing junkyard or automobile graveyard.
         (a)   Substantial intensification means any of the following:
            1.   Any geographic expansion of the facility;
            2.   The addition of any shredding, milling, grinding, baling or packing equipment for the handling of scrap or salvage materials, or the replacement of any existing shredding, milling, grinding, baling or packing equipment for the handling of scrap and salvage materials; and
            3.   The replacement of any existing shredding, milling, grinding, baling or packing equipment for the handling of scrap and salvage materials, which results in an increase of greater than 10% in the rated compression capacity, shear force capacity or other appropriate power or capacity measurement approved by the Code Enforcement Officer for the piece of equipment being replaced.
         (b)   A substantial alteration of a junkyard or automobile graveyard shall be subject to a CUP and all of the standards contained in this subsection (D).
