In addition to or in lieu of the criminal penalties authorized by this article, the County has the authority to assess a civil penalty of not more than $7,500 per violation against any person who has violated any provision of this article. Each separate day of a violation constitutes a new and separate violation. A person assessed a civil penalty under this section may appeal the assessment to the magistrate, who may waive, modify, or affirm the civil penalty. All civil fines collected pursuant to the provisions of this section shall be directed to fund the costs associated with stormwater education, correcting violations and/or enforcing the provisions of this article.

DIVISION 12. VARIANCES
The Director may grant a variance from the requirements of this article if exceptional circumstances applicable to a site exist such that strict adherence to the provisions of the article will result in unnecessary hardship and will not fulfill the intent of the article.

A written request for a variance shall be required and shall state the specific variance sought and the reasons, with supporting data, that a variance should be granted. The request shall include all information necessary to evaluate the proposed variance.
