The penalties for a violation of the provisions of this chapter shall be as follows:
(A) For local businesses with an alarm system:
(1) For the first citation issued in any one permit year for a false alarm or the operation of an illegal telephone dialing device, no fine shall be charged but a record of the violation shall be made;
(2) Upon a second violation within one permit year for a false alarm or the operation of an illegal telephone dialing device, a fine of $50 shall be imposed;
(3) Upon a third violation within one permit year for a false alarm or the operation of an illegal telephone dialing device, a fine of $75 shall be imposed; and
(4) Upon a fourth violation, and upon each and every violation thereafter, in any one certificate year, a fine of $100 shall be imposed for false alarms or the operation of an illegal telephone dialing device.
(B) For homeowners:
(1) For the first, second, third and fourth citation issued in any one certificate year for a false alarm or the operation of an illegal telephone dialing device, no fine shall be charged but a record of the violation shall be made;
(2) Upon a fifth violation within one certificate year for a false alarm or the operation of an illegal telephone dialing device, a fine of $50 shall be imposed;
(3) Upon a sixth violation within one certificate year for a false alarm or the operation of an illegal telephone dialing device, a fine of $75 shall be imposed; and
(4) Upon a seventh violation, and upon each and every violation thereafter, in any one certificate year, a fine of $100 shall be imposed for false alarms or the operation of an illegal telephone dialing device.
(C) In addition to the penalties set out in divisions (A) and (B) above, it shall be a separate violation to operate in the town any alarm system without a permit. Upon the first citation, no fine will be made. A second citation shall result in a fine of $100. For a third citation, and for each citation thereafter, the fine shall be $200.
(D) An alarm business shall be fined $200 for a failure to comply with the provisions of § 91.35 of this chapter regarding required registration.
