(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) A person who smokes in Town Hall or in a town building in violation of § 30.02 of this chapter commits a Class B infraction. However, the violation is a Class A infraction if the person has at least three previous, unrelated judgments for violating § 30.02 of this chapter which were accrued within the 12 months immediately preceding the violation, as provided by I.C. 7.1-5-12-4.
