§ 30.02 SMOKING IN TOWN-OWNED BUILDINGS.
   (A)   Designation of smoking and nonsmoking areas, Town Hall.
      (1)   Town Hall is a smoke-free building except for in the designated area for smoking as described in this subchapter.
      (2)   Conspicuous signs shall be posted in Town Hall in numbers sufficient to advise persons where smoking is prohibited by this subchapter and state law.
      (3)   The Town Council shall undertake all other duties set forth in I.C. 7.1-5-12-7.
      (4)   Smoking indoors is prohibited, including throughout the entirety of the Police Department.
   (B)   Designation of smoking and nonsmoking areas, town buildings.
      (1)   All other buildings owned by the town shall be smoke-free at all times.
      (2)   Conspicuous signs shall be posted at each site in numbers sufficient to advise persons that smoking is prohibited in said buildings by this subchapter and state law.
      (3)   The Town Council shall undertake all other duties set forth in I.C. 7.1-5-12-7.
   (C)   Designated smoking area policies.
      (1)   In order to promote good health and allow visitors and team members to have a smoke-free environment, smoking will be limited to the areas designated by this subchapter.
         (a)   Team members employed by the town are encouraged to refrain from smoking while performing town business.
         (b)   Smoking is prohibited within the Town Hall.
         (c)   All other buildings owned by the town shall be smoke-free, but a smoking area may be established in accordance with this subchapter and utilizing the following guidelines:
            1.   No smoking in confined offices or shared offices;
            2.   No smoking in areas which contain flammable or hazardous materials, including vehicles with gasoline; and
            3.   All smoking areas must allow for usage by nonsmokers and shall not cause smoke to infiltrate other areas.
         (d)   No smoking is allowed in vehicles when a nonsmoker is present, whether citizen or employee.
      (2)   Any infraction of this policy may result in disciplinary action.
