In the event that a department head becomes a defendant, either in his or her representative capacity or individually in any litigation arising out of the administration to this policy, the city and/or its insurers shall defend the department head of that action and pay any judgment entered in the action provided by the city, so long as the department head has made a good faith effort to comply with the terms and conditions set out in this handbook.
