§ 90.08 HUMANE TREATMENT.
   (A)   All dogs or small domestic animals when tied shall have not less than six feet of chain or rope attached to a collar. Fresh water shall be available at all times to any confined or tied animal, bird, or domestic pet.
   (B)   Shelter from freezing weather, snow, and rain must be provided. Tied animals must have access to a shaded area at all times.
   (C)   No animal shall be left in an automobile or similar enclosure without proper ventilation.
   (D)   No female animal in heat shall be tied out unguarded or allowed to run loose.
   (E)   No animal shall be abused, kicked, beaten, or cruelly treated.
   (F)   Living quarters and enclosures for animals shall be kept dry, clean, and free of drafts and vermin. Houses or shelters for animals shall have such materials as straw, hay, shavings, or some other such material for the winter bedding.
   (G)   Owner responsibility.
      (1)   All dogs and cats should have adequate care. “ADEQUATE CARE” means the provision of enough food, water, shelter, sanitary conditions, exercise and veterinary medical attention in order to maintain an animal in a good state of health.
      (2)   Every female animal in heat or rutting shall be restrained within a building or secure enclosure so that the animal cannot come into contact with a male animal of the same species except for planned breeding. Any unaltered male animal shall not be allowed to roam at large.
      (3)   Every owner of an animal within the city shall see that their animal:
         (a)   Is kept in a clean, sanitary, and healthy manner and is not confined so as to be forced to stand, sit, or lie in its own excrement. “SANITARY CONDITION” means space free from health hazards including excessive animal waste, overcrowding of animals, or other conditions that endanger the animal’s health. This definition does not include any condition resulting from a customary and reasonable practice pursuant to farming or animal husbandry.
         (b)   Is not chained or tethered outside in a continuous manner between the hours of 10:00 p.m. and 6:00 a.m.
         (c)   Is not restrained by the neck with the use of a rope, wire, chain, or other metal collar.
         (d)   If chained or tied outside, shall have available at all times for that animal a chain, leash, or lead, not less than ten feet or two and one-half lengths of the animal, whichever is the greater. However, this chain, leash, or lead cannot allow the animal to enter onto or into another persons’ property or onto the public right-of-way.
         (e)   Has sufficient and wholesome food and water, proper for that species of animal.
         (f)   Has a proper and adequate structure provided that will protect that animal from all elements of the weather and will allow that animal to stand, sit, and lie down without restriction.
         (g)   If ill, diseased, or injured, receive care as necessary to prevent the transmittal of the disease to other animals or prolong the suffering of the injured animal.
         (h)   Is not beaten, cruelly treated, overloaded, overworked, or otherwise abused, or cause, instigate, or permit any dog fight, cockfight, bullfight, or other combat between animals or between animals and humans.
         (i)   Is not physically altered in any manner by anyone other than a veterinarian with the exception of tattooing and grooming.
         (j)   Does not defecate upon private or public property unless the owner of the dog or cat promptly cleans up after the dog or cat.
      (4)   In addition to general animal care and treatment in this section, every owner or keeper of the dog kept within Greensburg city limits shall see that when such dog is confined outside:
         (a)   Has access to shelter that is made of weather resistant material, consisting of a structure with all solid sides, a dry floor raised above the ground, and a solid roof to protect the dog from weather and extreme cold/heat. During winter and any day that the weather reaches 40 degrees Fahrenheit and below, the shelter must be large enough for the dog to stand up and turn around, the entrance must be covered by flexible wind-proofing material or self-closing door, and must contain clean, dry bedding, which must consist of an insulating material that does not retain moisture, such as straw, not blankets, of sufficient depth to allow the dog to burrow. On any day when the temperature is at or above 80 degrees Fahrenheit, the shelter must be shaded by trees, a tarp, or a tarp-like device.
         (b)   Dog breeds that become susceptible in extreme weather should be brought in a temperature controlled facility, or when a heat advisory, freeze advisory, or a tornado warning has been issued by local, state, or national authority, except when the dog is in visual range of a competent adult who remains outside with the dog.
         (c)   Small breed dogs, which are defined as dogs that are less than 25 pounds and short hair, must be brought into a temperature-controlled facility when the temperature reaches 40 degrees Fahrenheit and 90 degrees Fahrenheit.
         (d)   Medium breed dogs, which are defined as dogs that weigh between 25 and 75 pounds, must be brought in a temperature-controlled facility when the temperature reaches 25 degrees Fahrenheit and 90 degrees Fahrenheit.
         (e)   Large breed dogs, which are defined as dogs that weigh more than 75 pounds, must be brought in a temperature-controlled facility when the temperature reaches 15 degrees Fahrenheit and 80 degrees Fahrenheit.
         (f)   As different breeds can thrive in different weather the final decision will be left to the determination of the Animal Control Officer. The breeds listed above are used for example and not meant to be the only breeds included.
      (5)   This section shall also apply to animals kept at the Greensburg-Decatur County Animal Control Shelter or by anyone acting on behalf of the Greensburg-Decatur County Animal Control Board.
