§ 38.20 FEES FOR GENERATION OF MAPS, COPYING PUBLIC RECORDS AND RELATED DOCUMENTS.
   (A)   The City Council hereby establishes the Electronic Map Generation Fund and the Enhanced Access Fund for all public record fees for the Sewer Department, Water Department and all other fees collected for the city with the exception of the Police Department. Fees collected under this section for providing electronic map generation and copying public records shall be deposited into these funds.
   (B)   Money in the Electronic Map Generation Fund shall be administered by the GIS Coordinator. Money in the Enhanced Access Fund shall be administered by the City Clerk or the Water Office Manager. All receipts from the Sewer Department and Water Department collected pursuant to this section shall be deposited in the Sewer Department funds and Water Department funds, respectively. All other fees collected pursuant to this section, with exception of the Police Department, shall be deposited with the funds of the Civil City of Greensburg, Indiana. Any fees collected pursuant to a contract for electronic map generation or copying records shall be deposited into their appropriate fund. Money in these funds shall be appropriated as approved by the Board of Works and may be used for the replacement, improvement, and expansion of capital expenditures, or the reimbursement of operating expenses incurred in providing the electronic map generation and or the copying of public records.
   (C)   All city offices are authorized to charge the fees as set forth in Appendix A: Schedule A.
   (D)   For the production of a printed map which requires GIS Manager or the Manager's designee to assemble data sets or complete specific analysis requests, a fee is established of $15 per hour, to be billed in increments of one-quarter hour with a minimum fee of $3.75. This fee is in addition to the fee for the printed map.
   (E)   Payment for the electronic generated maps or for copies under this section shall be made prior to the receiving of said maps or copies. A person requesting information to be provided by mail must also pay all postage or shipping cost. All requests for electronic generated maps or for copies pursuant to this section shall be made in writing on the form provided by the city or the respective department of the city to whom the request is made. Said form follows as Appendix B: Schedule B.
   (F)   A person who receives information or maps from the city electronic map generation or public record copies may not use the information for commercial purposes, including selling, advertising, or soliciting the purchase of merchandise, goods, or services, or sell, loan, giving away, or otherwise delivering the information to any other person for these purposes. A person who uses information in a manner contrary to this section may be prohibited from obtaining any further data.
   (G)   In the event the fees or other provisions of this section are in conflict with state law, the state law shall apply.
   (H)   The information on maps prepared from a Geographic Information System was established by the city for their internal purposes only, and was not designed or intended for general use by members of the public. City employees, agents and personnel make no representation or warranty as to its accuracy, and in particular, its accuracy as to labeling, dimensions, contours, property boundaries, or placement of location of any map features thereon; or to the accuracy of any other information contained thereon.
