§ 36.091 SICK LEAVE BANK.
   (A)   A sick leave bank of sick days is established for full-time employees who donate a minimum of 14 hours or 16 hours of unused sick leave from the previous year provided the employee has earned at least 42 sick hours. The annual enrollment period to join the sick leave bank shall be during the month of January each year. Employees who have exhausted all of their earned sick leave hours may donate their personal leave hours to meet the annual enrollment requirement.
   (B)   The sick leave bank is intended to be available for those employees who have exhausted all of their earned sick hours, vacation hours, comp time and personal hours and are experiencing an extended illness or condition covered by the Family and Medical Leave Policy.
   (C)   A Sick Leave Board, comprised of three members, is established by the Mayor to consider employee requests for use of sick bank hours.
   (D)   Employees eligible to apply to the sick leave bank must have donated the required sick days, and exhausted all available paid sick days, comp time, vacation days, personal days and holidays. Such employee must be off work on sick leave for at least 15 consecutive working days and make application to the Board in person or by representative. The maximum number of hours that may be granted per employee shall be 210 or 240 hours per application, and a maximum of 420 or 480 hours per year.
   (E)   From time to time it may be necessary for the Board to replenish the number of sick bank hours, and it shall have the authority to assess members additional sick hour donations. At such time as the sick leave bank falls below 400 hours, an obligatory assessment of seven or eight sick leave hours shall be made upon all current members of the bank who have sick or personal hours. For employees without available sick or personal hours, such assessment will be made during the following January if employed with the city or deducted from the final paycheck upon termination.
   (F)   If an employee wishes to join the sick leave bank, he or she must deposit the number of sick hours which would have normally been deposited had the employee participated in the program from either the time of its inception or the employee’s date of hire, whichever is less.
