§ 36.087 HOLIDAYS.
   (A)   (1)   The Council provides city employees with paid holidays each year. The Mayor shall specify when the paid holidays will be observed by the city each year. The holiday schedule will be appropriately posted in city facilities in December for the following year.
      (2)   The Mayor may designate other holidays at his or her discretion.
      (3)   According to applicable restrictions, the city will grant paid holiday time off to all eligible employees immediately upon assignment to an eligible employment classification.
      (4)   Time off on holidays shall be counted as hours worked for the purpose of calculating overtime hours, excluding Water Plant Operators. Holiday pay will be calculated based on the employee’s straight time pay rate (as of the date of the holiday) times the number of hours the employee would otherwise have worked on that day. (For example; seven hours, eight hours, ten hours, twelve hours).
      (5)   All full-time employees shall receive regular pay for those holidays designated by the Mayor. Part-time and temporary employees shall not receive compensation for holidays so designated.
      (6)   If an employee, excluding Water Plant Operators, is required to work on a recognized holiday, he or she will receive holiday pay at one and one-half times his or her straight-time rate for the hours worked on the holiday. Straight-time, or base rate, pay is the employee’s weekly rate of pay divided by the regular number of work week hours.
      (7)   Before being paid for holidays the employee shall have worked the immediately preceding scheduled work day and the next succeeding work day, unless excused for vacation leave or excused from work using a sick day because of personal illness.
   (B)   Water Plant Operators. Water Plant Operators shall receive holiday pay for each designated holiday. Holiday pay will be calculated based on the employee’s straight time pay rate (as of the date of the holiday) times the number of hours the employee would otherwise have worked on that day. Operators who are required to work their regularly scheduled workday on holidays shall receive holiday pay plus straight time pay for the hours worked on the holiday. Only hours actually worked on the holiday will be used in calculating overtime.
