13-1-6: SEIZURE AND DESTRUCTION OF MACHINES:
If any duly authorized enforcement officer of or for the Village shall have reason to believe any amusement device is used as a gambling device, such machine may be seized by the officer and impounded, and if upon trial of the licensee or operator for allowing it to be used as a gambling device, said licensee or operator be found guilty, such machine may be destroyed by order of court, pursuant to 720 Illinois Compiled Statutes 5/28-1 et seq.
If any duly authorized enforcement officer of or for the Village shall have reasonable basis for believing any vending machine, jukebox or amusement device is operating unlicensed, it may be seized by any duly authorized enforcement officer and impounded. When a machine is impounded for failure to have or display a license, the machine shall be held until the owner pays the appropriate license fee and all costs of seizure, cartage and impounding, including five dollars ($5.00) per day for storage. If the machine is not licensed and costs paid within thirty (30) days after impounding, the machine may be destroyed. (Ord. 97-08, 6-11-1997)
