13-1-3-2: APPLICATION:
The application for all licenses, including proprietary licenses shall contain the following information:
   A.   Name and address of the applicant, date of birth and place of birth.
   B.   Prior criminal convictions of applicant, if any.
   C.   Place where machine or device is to be displayed or operated and the business conducted at that place.
   D.   Description of machine to be covered by the license, mechanical features, name of manufacturer and serial number.
   E.   Name, address and date of birth of any and all officers of the corporation.
   F.   Any convictions of criminal laws by officers of the corporation.
   G.   Any information that is required by the Village President and included on said application or that may be required by the Village President at a later date to conduct a proper investigation for purposes of this Chapter.
   H.   The application will be completed in full and with all questions answered.
No such license shall be issued until the original application has been completely filled out and referred to the Village President for investigation and verification of the facts stated therein and the business methods of the operator. Any omission on the application or untruthfulness of the applicant shall be cause for the refusal or revocation of said license. Unless the Village President shall find that the operator has been convicted of a felony or that he has violated any law or ordinance imposing any tax, or if either the owner or operator has employed coercive or illegal measures to promote the use of this device, or that the place where said machine is to be used is not qualified under the provisions of this Chapter or any other ordinance of the Village, or that the applicant is not of good moral character, he shall return said application to the Clerk of the Village with his approval. Otherwise he shall return the application with a statement of his reasons for refusing to approve the application.
Any person applying for an amusement device license, cigarette vending machine or jukebox license shall make himself available to the Village officials for purposes of being fingerprinted to determine criminal record, if any, of the applicant. This requirement shall include officers or directors of any corporate applicant. Failure to do so will justify refusal for issuance of license.
Any person whose application has been rejected by reason of licensing investigation shall have a right to appeal from such decision to the Village Board within ten (10) days of date of rejection notice. The Board shall establish a time and place for such hearing at which the applicant and his attorney may be present, present witnesses and submit evidence. Following such hearing, the Village Board shall have a right to confirm such rejection or to order the license to be issued. (Ord. 97-08, 6-11-1997)
