10-1-3: WORDS AND PHRASES DEFINED:
All words and phrases used in this Title and defined in the Illinois Liquor Control Act of 1934 (235 Illinois Compiled Statutes, et seq.) shall have the same meaning as they have in said Act unless otherwise herein defined as follows: (Ord. 89-10, 7-26-89)
NOT-FOR-PROFIT SPONSORED RESTAURANT: A restaurant which is owned and operated by a not-for-profit corporation which operates the restaurant for the purpose of providing vocational, residential and social support services for mentally retarded or developmentally disabled individuals. Pursuant to such purpose, alcoholic liquor may be dispensed on a regular basis within buildings housing a not-for-profit sponsored restaurant, and on a temporary basis at other locations as may be approved by the Board of Trustees on the same premises on which the building housing the not-for-profit sponsored restaurant is located. RESTAURANT: Any public place kept, used, maintained, advertised and held out to the public as a place where meals are served, and where meals actually are served and regularly served, such space being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein sufficient number and kind of employees to prepare, cook, and serve suitable food for its guests; provided, that the revenues of premises licensed as a restaurant to sell alcoholic liquor shall be derived at least sixty percent (60%) from the sale of food; and provided further, that no premises licensed as a restaurant shall sell alcoholic liquor except to persons having or about to have a meal.
