9-4-5: INSPECTION OF IMPROVEMENTS:
   A.   Required: All required land improvements to be installed under the provisions of this Title shall be inspected at the subdivider's expense. The Engineer, at the expense of the subdivider, shall provide an inspector on the job during the process of construction. When the work has been completed, the Engineer shall certify that the improvements comply in all respects with the approved plans and specifications, and with the requirements of this Title. All required land improvements to be installed under the provisions of this Title shall be inspected at the subdivider's expense. All work shall also be at all times subject to inspection by the Village Road Commissioner, the Health Officer, the Village Engineer and other Village officials and their representatives.
   B.   Notification to Village Officials: Before starting the construction of any improvements, the subdivider shall ascertain from the Village Road Commissioner, Health Officer and the Village Engineer what inspections are required and the amount of notification desired in each case, and shall comply with all their rules, regulations, and instructions pertaining to such required inspections.
   C.   Reports: Any inspection which requires that the Village Road Commissioner, the Health Officer or the Village Engineer be present shall be made by that official or his agent and reported in written form, and one copy shall be furnished to the Engineer or other agent of the subdivider.
   D.   Responsibility of Subdivider: Regardless of contracts, agreements or inspections performed, final responsibility for the installation of all improvements, in accordance with the applicable standards, rests with the subdivider.
   E.   Approval and Acceptance:
      1.   Street; Drainage Improvements: When street, water, sewer and drainage improvements and all appurtenances thereto, based on approved plans, have been constructed or installed and passed all inspections, the corporate authorities shall provide the developer with a letter of approval, completion, and acceptance by the Village subject to the requirements of subsection 9-4-4F of this Chapter.
      2.   Health and Sanitation Facilities: When health and sanitary facilities, based on approved plans, have passed all inspections, the Health Officer shall provide the developer with a letter of approval and completion. Such letter shall not constitute acceptance by the public; it shall be the responsibility for the agency intending to maintain and operate the facility to provide the developer with a letter of acceptance subject to the requirements of subsection 9-4-4F of this Chapter.
      3.   Water and Sewer Improvements: When any required sewer or water improvement is not intended for public ownership, the appropriate inspecting agency shall provide the developer with a letter of approval and completion. Such letter shall not constitute acceptance by the public but shall permit the owner to operate and maintain the facility. (Ord. 90-03, 7-25-90)
