9-2-1-1: APPLICATION:
The Village shall provide an application form to be submitted by the owner or his authorized agent. The application shall be submitted to the Village Clerk with supporting documents and the filing fee and deposit. An application shall be submitted before each of the stages, namely: sketch plan, preliminary plat and final plat. The application form may be the same for each stage, provided the information is up to date at the time of each application and it is accompanied by the supplementary documents required at that stage.
   A.   Application Form: The application form shall contain the following information: (Ord. 90-03, 7-25-90)
      1.   Land owner with verification of owner as hereinafter required. (Ord. 94-23, 9-28-94)
      2.   Legal description.
      3.   Proposed developer (if different).
      4.   Consultants (if known), including engineer, surveyor, planner, and others.
      5.   Description of proposed subdivision.
      6.   Approximate acreage and proposed number of lots.
      7.   Name of proposed subdivision.
      8.   Such other information as the board may direct.
   B.   Surveys And Other Documents: Surveys and other documents as set forth in the following sections shall be submitted with the application. The applicant shall provide twenty (20) copies (unless otherwise hereinafter provided), of every document submitted. All documents shall either be on eight and one-half inch by eleven inch (81/2" x 11") paper or folded into a size not over nine inches by twelve inches (9" x 12").
   C.   Plan Or Plat: The application shall include a sketch plan or proposed preliminary or final plat. (Ord. 90-03, 7-25-1990)
   D.   Filing Fees And Deposits: The applicant shall pay at the time of filing each application: 1) a nonrefundable filing fee to defray the costs and expenses of the village board and plan commission review of the plan or plat submitted; and where appropriate 2) an escrow deposit consistent with the provisions of title 2, chapter 4, "Development Fees And Costs", of this code.    E.   Costs Charged For Plat Review: As required by title 2, chapter 4, "Development Fees And Costs", of this code.
   F.   Reimbursement Of Escrow Fund: As required by title 2, chapter 4, "Development Fees And Costs", of this code. (Ord. 2012-O-10, 8-22-2012)
   G.   Filing: The applicant shall submit twenty (20) copies of each of the application form, the survey, and the sketch plan or preliminary plat or final plat and supporting documents to the village clerk. At the time of filing, applicant shall pay the filing fee in cash or certified funds.
   H.   Distribution: Within ten (10) days after applicant has filed a complete application, the village clerk shall deliver one copy to each of the following: all village board members, all plan commission members, the Village Engineer, the Village Attorney and the Village Zoning Officer.
   I.   Board Action: Within forty five (45) days of the filing of the application, the Board shall direct the Plan Commission, the Village Engineer and the Village Zoning Officer to meet with applicant. In the case of a sketch plan, the plan shall be reviewed for guidance and information regarding the proposed subdivision of the land and the applicant advised accordingly. In the case of a preliminary or final plat, the plat shall be reviewed for conformance, hearings conducted as hereinafter required, and reports submitted to the Village Board within sixty five (65) days after receipt by the Plan Commission; and the Village Board shall accept or reject the plat within forty five (45) days after receiving the Plan Commission report thereon.
   J.   Extension of Time: In the event that the Plan Commission or the Village Board wishes to delay action on making its report of accepting or rejecting, as the case may be, the date for such action may be extended only by agreement with the applicant. (Ord. 90-03, 7-25-90)
   K.   Proof of Ownership: The application form, at each stage shall be accompanied by a current title commitment from a title insurance company licensed in the State setting forth the present ownership of all of the property proposed to be included in the subdivision, along with copies of all document, plats or other matters of record which are raised as an exception or objection to clear merchantable title to the premises. Applications, after the first stage, may be accompanied by the original commitment and documents, etc., provided that the owner shall verify that the condition of title has not changed since the submission of the original commitment.
   L.   Taxes: No parcel shall be considered for resubdivision if there are any delinquent real estate taxes shown to be due by the title commitment.
   M.   Signature: The application shall be signed by the proposed developer, and, (if different), the owner or owners of record. (Ord. 94-23, 9-28-94)
