9-1-11-2: PARKS, PRESERVES AND OTHER PUBLIC AREAS:
   A.   Requirement And Population Ratio: The ultimate density of a proposed development shall bear directly upon the amount of land required for dedication. The total requirement shall be one acre of land per one hundred fifty (1:150) of ultimate population in accordance with the following standards by types of recreational and park areas:
      1.   Neighborhood park: Minimum one acre.
      2.   Villagewide recreational park: Minimum five (5) acres.
   B.   Population Formula: The formula used shall be four and four-tenths (4.4) population per lot.
   C.   Location:
      1.   Neighborhood parks are to be located within the subdivision or added to another adjacent subdivision.
      2.   Villagewide parks shall be located in accordance with the requirements of the comprehensive plan or as recommended by the plan commission and approved by the board of trustees.
   D.   Credit For Private Open Spaces And Recreational Areas: When subdividers provide their own space for recreational areas and facilities, it has the effect of reducing the demand for public recreational services. Depending on the size of the subdivision, a portion of the park and recreational area in the subdivision may, at the option of the board of trustees, be provided in the form of "public" open space. The extent of same shall be determined by the board of trustees, based upon the needs projected by residents and in conformance to the total park and recreation land for the general area.
   E.   Criteria For Requiring A Cash Contribution In Lieu Of Land Dedication:
      1.   Cash Contribution: Where the subdivision is small and the resulting site is too small to be practical or where the available land is inappropriate for school site, park site or other public use, the village may require the subdivider to pay a cash contribution in lieu of land dedication. The cash contribution in lieu of land dedication shall be held by the village solely for the acquisition of a school site, park site or public land facilities or buildings which will be available to serve the immediate or future needs of the residents of that subdivision and the general village residents or for the improvement of other existing public land which already serves such needs. This contribution shall be designated by the board of trustees for a specific use within ten (10) years of the completion of the subdivision.
      2.   Fair Market Value: The cash contributions in lieu of land shall be based on the "fair market value" of the acres of land in the area improved as specified herein, that otherwise would have been dedicated as park and recreation sites. The subdivider shall submit an appraisal showing the "fair market value" of such improved land in the area of his development or other evidence thereof and final determination of said "fair market value" of such improved land in the area of his development or other evidence thereof and final determination of said "fair market value" per acre of such improved land shall be made by the board of trustees based upon such information submitted by the subdivider.
   F.   Criteria For Requiring Land Dedication And A Contribution: There may be situations where it will be necessary to require a combination of land dedication and a contribution to meet the needs of this chapter. Such recommendations shall be made by the plan commission and approved by the board of trustees.
   G.   Reservation Of Additional Land: Where the development plan or the requirements of the village call for a larger amount of park and recreational land in a particular subdivision than the developer, is required to dedicate, the land needed beyond the developers contribution shall be reserved for subsequent purchase by the village or other public body designated by the village; provided, that such acquisition is made within one year from the date of approval of the final plat, or an agreement between the developer and the village is recorded outlining specific conditions for the conveyance of such property.
   H.   Combining With Adjoining Developments: Where the subdivision is less than forty (40) acres, public open space which is to be dedicated should, where possible, be combined with dedications from adjoining subdivisions in order to produce usable recreation areas without hardship on a particular subdivider.
   I.   Topography And Grading: The slope, topography and geology of the dedicated site as well as its surroundings must be suitable for its intended purposes.
   J.   Improvement Of Sites: Parks and recreational sites shall be dedicated fully developed ready for use. "Fully developed" shall mean all site grading including surface drainage and seeding and sodding required for the intended use, but not including final development such as baseball, tennis or like facilities nor any structures. "Fully developed" shall also mean providing adequate access to and fully developed perimeter streets. (Ord. 90-O-03, 7-25-1990)
