9-1-10: OPEN SPACE CONVEYANCE:
Whenever any area in a proposed subdivision is designated to be devoted to open space use, nature conservancy, trailways, storm detention or other use which is public, or in the interest of the public, the area shall be titled as an "outlot", and shall be conveyed to an appropriate agency, not for profit corporation, municipality or other entity which shall own and control the area, and shall be obligated to control and maintain the character and use of the area in accordance with the designated purposes. If the village does not have an appropriate grantee available to take title to said area, it shall be conveyed to the village subject to the condition that the area be used and maintained only in accordance with such designated use.
