AN ORDINANCE AMENDING THE BUILDING PERMIT FEE SCHEDULE TO PROVIDE FOR INCREASED FEES FOR AFTER-THE-FACT PERMITS

WHEREAS, the Corporate Authority has found that where property improvements requiring a building permit and fee are made without obtaining the required permit there is a substantial additional cost to the Village for it to require the permit application to be made after the fact of the improvement being made in whole or in part; and

WHEREAS , a higher fee should be established for obtaining such after-the-fact permits.

NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE OF GREEN OAKS, LAKE COUNTY, ILLINOIS , as follows:

SECTION I:      That Section 7-3-8-1 entitled “Examination of Plans” of Chapter 3, of Title 7 of the Green Oaks Village Code is hereby amended as follows, where strikeout (deleted) indicates deleted text, and where double underline (insert) indicates new text, and three asterisks (***) indicates existing Sections of the text of the zoning ordinance that are not being amended:

7-3-8: FEES:

7-3-8-1: EXAMINATION OF PLANS:

A. The fees set forth, from time to time, by resolution of the corporate authorities for the examination of plans shall be paid to the village at the time plans are submitted to the village for examination and shall not be refunded.

B. In the event a structure or portion of a structure requiring a permit under this Code is wholly or partially constructed without a permit being issued therefor, the fee for the after-the-fact permit shall be two hundred percent (200%) of the fee then established for the permit if the structure or improvement had been obtained prior to commencement of construction or improvement.

SECTION II:      Nothing in this Ordinance shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action arising, acquired or existing under any act or ordinance or portion thereof hereby repealed or amended by this ordinance; nor shall any just or legal right, claim, penalty or remedy of any character of the corporate authority existing on the effective date hereof be lost, impaired or affected by this Ordinance.

SECTION III:   If any provision, clause, sentence, paragraph, section, or part of this ordinance or application thereof to any person, firm, corporation, public agency or circumstance, shall, for any reason, be adjudged by a court of competent jurisdiction to be unconstitutional or invalid, said judgment shall not affect, impair or invalidate the remainder of this ordinance and the application of such provision to other persons, firms, corporation, or circumstances, but shall be confined in its operation to the provision, clause, sentence, paragraph, section, or part thereof directly involved in the controversy in which such judgment shall have been rendered and to the person, firm, corporation, or circumstances involved. It is hereby declared to be the legislative intent of the Corporate Authorities that this ordinance would have been adopted had such unconstitutional or invalid provision, clause, sentence, paragraph, section, or part thereof not been included.

SECTION IV:   This ordinance shall be in full force and effect from and after its passage and approval and publication in pamphlet form as required by law.
