1333.05 LICENSEE REPORT; PERMIT RENEWAL, REVOCATION AND FEE.
   (a)   Present Group Homes. Group homes presently operating at the time for renewals of their permits or certificates, shall comply with this chapter, or discontinue operation.
   (b)   Report. After a permit has been granted, the licensee of the group home shall submit to Council or the Municipal Manager a written formal progress report, along with the comments of the sponsoring organization, by June 15 and December 15 of each year, which report shall describe the group home's operation in the past six months, specifically detailing problem areas, successes and any anticipated changes in operation.
   (c)   Renewal of Permit. Each licensee shall apply annually to the Municipal Manager for renewals of its special permit not less than ninety days before the expiration date of the permit. Before renewing any special permit for a group home, Council shall hold a public hearing. Council shall give thirty days notice of the time and place thereof in a newspaper of general circulation in the Village, and shall notify by ordinary mail all owners of property of abutting the lot to be used for the proposed group home at least fifteen days prior to the date of such public hearing. Council shall review such renewal request, and if continuing compliance with this chapter and the terms of the special permit is found, the special permit shall be renewed.
   (d)   Revocation. A licensee's failure to comply with the conditions of its permit or with any standards provided herein shall be grounds for revocation, suspension or modification of the terms of the permit by Council.
   (e)   Permit Fee. The application fee for the original issue of a special permit is two hundred and fifty dollars ($250.00) and the annual fee for the renewal of such special permit is one hundred dollars ($100.00).
   (f)   Modification. All modifications, amendments or other changes in the use of a group home as approved herein shall be submitted to the Municipal Manager for processing according to the procedures set forth in subsections (b) and (c) hereof.
   (g)   Severability. If any provision of this chapter is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, the remaining provisions of this chapter shall not be invalidated.
