705.99 GENERAL CODE PENALTY.
   (a)   Any business owner(s), or occupant(s) not in compliance with this Chapter 705 will be subject to an administrative fine of up to one hundred dollars ($100.00) per day for each day the violation exists. In addition, any violation of this Chapter 705 for ten days or more will result in a minor misdemeanor offense upon notice of noncompliance.
   (b)   Any property owner(s), or agent(s) thereof, that allows any entity or person to take possession of any rented, leased, bartered, borrowed, or otherwise conveyed space without receiving a certified copy of the license shall be fined two hundred fifty dollars ($250.00) for the first offense and five hundred dollars ($500.00) for each offense thereafter. Fines not paid in full within ten days of written notice will be filed with the Hamilton County Auditor for placement of a lien on the offending property.
   (c)   In addition to any other remedy provided for herein, the Village Council may determine by Ordinance that a violation of this Chapter 705 constitutes a public nuisance. Upon such declaration of public nuisance, the Municipal Manager shall take such action as may be necessary to abate such nuisance, including, but not limited to the following:
      (1)   Immediate revocation of any Zoning Certificate;
      (2)   Erection of any appropriate placard indicating that the property has been declared a public nuisance and declaring that the premises may not be occupied or utilized until such violation has been corrected;
      (3)   Installation of chains, locks, or other mechanism to prevent to occupancy or use of the premises until such violation has been corrected; or
      (4)   Any other action permitted by law.
