509.12 DAYTIME CURFEW.
   (a)   No child between the ages of six and eighteen shall be upon or about public streets, public places, commercial establishments or places of amusement and entertainment within the Village of Greenhills during hours when said child is required to be in attendance at either a public or private school, an alternative program, temporarily assigned to Homebound instruction or is under suspension or expulsion from a public or private school, unless said child is accompanied by a parent, guardian, or other adult person having the care and custody of him or her, or it is upon an emergency errand or other legitimate business directed by a parent, guardian or other adult person having the care and custody of him or her. A child who has been suspended or expelled but also has been placed in and is attending an alternate learning center or a temporary Homebound Instruction program approved by the Board of Education of the child’s school district shall be considered to be in compliance with this section. If such child attends the alternate learning center or temporary Homebound Instruction program during its required hours. A child placed in a bona fide home schooling program shall not be subject to this section.
   (b)   Any law enforcement officer or police officer may arrest any child found violating this section and charge such child with a violation of this section, or in the alternative, may immediately take such child to said child’s school and request that the school notify the appropriate school administrator or attendance officer of such violation, or release such child to his or her parent, guardian, person in loco parentis, appropriate school administrator, or attendance officer.
   (c)   No parent, guardian, or other adult person having the care, custody, or supervision of a child shall permit such child to violate the provisions of subsection (a) hereof.
   (d)   Any minor violating any provision of this section shall be adjudicated an unruly child and shall be dealt with in accordance with juvenile law and procedure.
   (e)   Any parent, guardian or other adult person having the care, custody, or supervision of a child who violates any provision of this section is guilty of a minor misdemeanor. It is a separate offense for each day or part of a day during which the violation is committed.
