(a) No person shall fail to properly supervise a child if the person is the parent, lawful guardian, or other adult charged with the responsibility of the care and custody of a child under eighteen years of age. A person commits the offense of failing to supervise a child if a child under the person’s care and custody engages in two or more of the following acts within a two year period:
(1) Commits an act that brings the child within the jurisdiction of the Hamilton County Juvenile Court;
(2) Violates the Municipal Curfew Statute under Section
(3) Is truant from school in violation of the laws of the State of Ohio requiring school attendance.
(b) No person may be found guilty of violation of the provisions of this section if the person:
(1) Is the victim of the act that brought the child within the jurisdiction of the Juvenile Court; or
(2) Reported the act of the child to the appropriate authorities; or
(3) Took reasonable steps to control the child’s conduct at the time the person is alleged to have failed to supervise the child.
(c) If a child commits an act prescribed by subsection (a) hereof and the child has not been adjudicated or found to be unruly or delinquent in a prior action within the prior two years, the child’s parent, legal guardian, or other adult charged with the responsibility of the care and custody of the child shall be issued a notice from the Village Police Department warning the person of the penalty for failure to supervise a child. If the child commits a second act within two years of the first act, the parent, legal guardian or other adult charged with the responsibility of the child shall be charged with failure to supervise a child.
(d) Whoever violates this section is guilty of a minor misdemeanor.
