§ 51.083 EMERGENCY LATERAL REPLACEMENT PROGRAM.
   (A)   The Wastewater Utility may fund a project to assist single-family homeowners with the total replacement of a private lateral. Under no circumstances can ownership of the private line be relinquished to the Wastewater Utility. Assistance by such program requires the residing single-family homeowner of the property to notify the Wastewater Utility of a major or continuing problem with interrupted sanitary sewer service.
   (B)   The applicant shall first have received the approval of the Wastewater Utility Manager or appointed representative to participate in the program, which participation shall require each owner to perform the following steps, as well as any other actions required by the Wastewater Utility Manager:
      (1)   Complete an application provided by the Wastewater Utility;
      (2)   At the owner’s expense, have their lateral service and televised concurrently, if possible; and
      (3)   Provide property access to a contractor for the repair or replacement of the lateral.
   (C)   The Wastewater Utility will require sufficient time to acquire an outside contractor when needed and request applicable locations(s) from the State Underground Plant Protection Service to prevent other service lines from being damaged. The contractor will repair all lawns, sidewalks, drives, and streets. The Wastewater Utility Manager reserves the right to refuse or delay the assistance offered by this program to anyone, providing the reasons for such actions are explained to the residing homeowner. Commercial, industrial, and rental properties are not eligible for this program. Grievances shall be addressed at a Board of Works and Public Safety meeting for resolution. A financial penalty may occur for a homeowner who sells a property within two years of applying for an emergency lateral replacement. The Board may impose a penalty equal to the greater of $1,000, or an amount equal to the quotation obtained by the Wastewater Utility, for the emergency lateral replacement at the time of the proposed transfer of any legal interest in the subject real estate.
