§ 114.99  PENALTY.
   Any person who violated any of the provisions of this chapter shall be guilty of a misdemeanor. On conviction, the violator shall be punished for the first offense by a fine of not more than $500, plus all costs and attorneys fees for the collection of such fines; for the second offense by a fine of not more than $1,000; and, for a third offense and each subsequent offense, by a fine of not more that $1,000, plus all costs and attorneys fees for the collection of such fines, to which may be added imprisonment for any determinate period not exceeding 90 days. Each day of operation of food market in violation of § 114.02(A) or after the expiration of the time limit for abating insanitary conditions and completing improvements to abate the conditions as ordered by the Health Officer shall constitute a distinct and separate offense.
