All roadway ditch enclosures performed by the city shall be done in accordance with one of the following two procedures.
(A) Enclosures/culvert pipe installation performed by the property owner.
(1) Prior to commencing any drainage work within the city right-of-way, the property owner or property owner’s contractor shall be required to obtain a storm water drainage permit, as provided in § 150.16, from the City Storm Water Division; provided the ditch qualifies under the city’s right-of-way construction regulations.
(2) Upon receipt of a drainage permit, but prior to the commencement of any work, the property owner or property owner’s contractor shall submit a copy of the permit and plans of the proposed drainage work to the Storm Water Superintendent or City Engineer for approval.
(3) Upon signature of the plans by the Storm Water Superintendent or the City Engineer, the property owner or contractor shall obtain a performance bond, as provided in § 150.16, equal to the value and scope of the proposed work.
(4) Upon completion of work, but prior to backfilling, an inspection of the property owner’s and/or property owner’s contracted work will be made by the Storm Water Superintendent or City Engineer. This inspection process will include both pre-backfilling and post-backfilling inspections. Upon final inspection of grading within the right-of-way, the site shall be seeded and mulched.
(5) Upon completion, all pipe and other drainage components shall remain the property of the city.
(B) Enclosures/culvert pipe installation performed by the city.
(1) The city will perform ditch enclosures, culvert pipe installation and culvert replacements at the property owner’s request and at the property owner’s expense; provided the ditch qualifies under the city’s right-of-way construction regulations.
(2) The property owner must pay the city in advance for all necessary materials, including pipe, catch basins and other material deemed necessary.
(3) The property owner must pay the city in advance for labor and equipment to excavate and install drainage material, including backfill.
(4) The city will waive fees for permits and bonds.
(5) The property owner will be subject to the scheduling, installation decisions and priority of work established by the Storm Water Superintendent.
(6) The property owner is responsible for landscaping, including fine-grading and seeding, upon final completion of the drainage work.
(7) The pipe and other drainage components shall remain the property of the city.
(8) This policy only applies to requests for road and right-of-way drainage improvements that exceed maintenance and repair the city is required to perform under the Ohio Revised Code.
