§ 54.003   EXCEPTIONS
   The provisions of this chapter shall not apply to any of the following sales or persons:
   (A)   Persons selling goods pursuant to an order or process of a court of competent jurisdiction or those items repossessed and sold pursuant to the Uniform Commercial Code or a purchase money security agreement or to extinguish a statutory lien.
   (B)   Any person selling or advertising to sell an item or items of personal property which are specifically named in the advertisement and which separate items do not exceed four (4) in number.
   (C)   Sales conducted by recognized religious, charitable, educational, civic, or fraternal corporations or associations.
   (D)   Bake sales, hot dog sales, candy sales, farmers’ produce sales, or other similar food sales are specifically not included within the definitions of § 54.001.
