§ 40.304   FIRE LANES
   (A)   Definition. For the purpose of this section, the following definition shall apply unless the context indicates or clearly requires a different meaning.
   “PARKING AREA.” Any area designed, arranged, or used for the storage or parking of automobiles or other motor vehicles not enclosed by four (4) walls.
   (B)   All public or private structures with a parking area containing fifty (50) or more parking spaces, and all emergency facilities, schools, and health care facilities, regardless of size, shall have fire lanes in the parking area and located as designated by the Fire Chief.
   (C)   The fire lanes shall be not less than ten (10) feet in length, nor more than twenty (20) feet in width as designated by the Fire Chief. The area encompassed by the fire lane shall be painted in traffic yellow stripes four (4) inches in width. The words “FIRE LANE” shall also be painted in a location designated by the Fire Chief in traffic yellow, with letters a minimum of six (6) inches in width.
   (D)   The fire lane shall be marked with a regulation sign measuring twelve (12) inches by eighteen (18) inches stating “NO PARKING - FIRE LANE”. The signs shall be permanently mounted and shall be between five (5) feet and six (6) feet in height, measuring from the bottom of the sign.
   (E)   It is not the purpose of this section to limit or restrict the use of fire lanes as set forth above for ingress or egress by customers or employees unless and until an emergency use of the fire lane is required. In all other respects, the fire lanes shall be available for use by the general public, except for parking and loading and unloading purposes.
   (F)   The proprietor shall bear all costs involved in creating the fire lanes required pursuant to this section.
