SECTION 2.05. VACANCIES AND RESIGNATIONS.

   (1)   A Councilmember’s seat shall be declared vacant upon the occurrence of any of the following, a Councilmember:

      (A)   Submits a letter of resignation to Council;

      (B)   Ceases to be a qualified elector in the municipality;

      (C)   Enters upon the performance of the duties of an incompatible office;

      (D)   Is deceased while in office;

      (E)   Is convicted of malfeasance or misfeasance in office, in accordance with Section 10.03 of this Charter; or

   (2)   A Councilmember’s seat may be declare vacant if a Councilmember is absent from at least one-third of the regular meetings of Council in any calendar quarter without excuses acceptable to Council.

   (3)   Upon the occurrence of a vacancy created by an occurrence of any subdivision of 2.05(1) or 2.05 (2) of this Charter, the Council shall adopt a resolution declaring the Councilmember’s seat vacant.
