(a) The hunting season established herein shall open fourteen (14) days prior to the opening of the statewide deer archery season as established by the West Virginia Department of Natural Resources and shall close fourteen (14) days later. Town Council, in its sole discretion, may cancel or shorten the season by resolution adopted at any time prior to or during the season.

(b) This Code provision shall not supersede any other provisions of the Codified Ordinances of the Town of Granville pertaining to the use of archery devices, bows or firearms except as may be expressly modified by this article.
(c) During the hunting season established in this article, deer may be hunted with a bow only.
(d) All rules and regulations established by the West Virginia Division of Natural Resources pertaining to hunting are incorporated herein by reference and shall be obeyed by all persons participating in the hunting season established by this article.
(e) All persons who desire to participate in the hunting season established by this article shall be required to hold a valid hunting license issued by the State of West Virginia.
(f) Prior to engaging in any hunting activity under this article, any person desiring to participate in the hunt shall make application to the Town and shall pay a fee of one dollar ($1.00). There shall be no more than fifty permits issued each year. Town Council, in its sole discretion, may decrease the number of permits to be issued in any given year by resolution. The first half of the total number of persons issued permits each year shall be permitted to hunt the first week of the hunting season as defined herein, and the second half of the total number of persons issued permits shall be permitted to hunt during the second week of said season. Permits shall be issued on a first come first serve basis and application must be made in person at Granville Town Hall. Permits will be issued beginning two weeks prior to the hunting season defined in this article.
(g) No person issued a permit to hunt under this article shall be permitted to enter any private property, for the purpose of hunting or otherwise, without written permission from the property owner and without filing a copy of the document granting such permission to the Town prior to entering such private property. Further, no person shall hunt on any public property unless the same has been clearly designated as a hunting area as set forth in Section 1160.03(l).
(h) In addition to any provisions set forth by the West Virginia Department of Natural Resources, any individual who successfully harvests a deer during the urban hunt shall report the harvest to the Granville Police Department or authorized agent within two days. The deer shall be field tagged in accordance with West Virginia State Law.
(i) Any legally, licensed hunter may harvest two deer of any sex during this special hunting period.
(j) Nothing in this deer control policy shall authorize the parking or standing of a motor vehicle or the operation of an all-terrain vehicle on the property of another without the express permission of the property owner.
(k) The use and operation of all-terrain vehicles is prohibited during the urban deer hunting season.
(l) The Town shall set the boundaries of the public areas to be utilized for the hunt. These areas will be clearly marked.
(m) No person shall possess, consume, or be under the influence of alcohol or controlled substances while engaged in hunting activities within the Town limits of Granville. “Under the influence” is defined as having an alcohol concentration in a person’s blood of eight hundredths of one percent or more. By participating in the hunting season established herein, a person shall be deemed to have given his or her consent to a breath analysis as set forth in W. Va. Code 17C-5-4.
(n) Any person who harvests a deer during the urban hunt shall follow all guidelines for field cleaning required by the West Virginia Department of Natural Resources.
(o) Any person who harvests a deer while hunting shall not field dress the deer in view of the public.
(p) Any person who fields or otherwise processes a deer shall properly dispose of the discarded organs and/or body parts in plastic bags in private trash depositories. Nothing contained herein shall authorize the dumping of solid waste, deer carcass, or any part of the animal on public or private property.
(q) The transportation of any harvested deer along any public right of way is prohibited unless it is covered or hidden from public view.
(r) As a pre-requisite to obtaining a permit to participate in any hunting activity under this article, all persons shall be required to execute a Hold Harmless Agreement and Release of Liability in a form prescribed by the Town.
