(A) The city may grant a waiver to discharge clear water into the city's sanitary sewer system where strict enforcement would cause a threat of damage or harm to other property, the environment, or public safety because of circumstances unique to the individual property or due to physical conditions, weather conditions, or excessive financial hardship. A written request for a waiver must be first submitted to the city specifying the reasons for the waiver. The Utility Commission would determine if the situation described in the written request would justify a temporary or permanent waiver.
(B) The Utility Commission may set conditions to the waiver. The Utility Commission may terminate the waiver upon a failure to comply with any conditions imposed on the waiver. The Utility Commission would give a 60-day written notice of the termination to the property owner and occupant setting forth the reasons for the termination. After expiration or termination of a waiver, the property owner shall comply with the provisions of this chapter.
