8-3-9: AUTHORITY OF CITY:
Nothing in this Chapter shall prohibit the City, without charge to the owners of abutting property, from eradicating injurious pests and diseases, or pruning trees located within the public right of way.
Furthermore, in the event any tree or shrub is the responsibility of any property owner under the terms of this Chapter, and after an appropriate thirty (30) day notice has been personally delivered to such person, and any problem continues to exist, the City may enter upon such property and cure such problem, having then a right of action against said property owner for all sums incurred. The City before entering onto private property for the eradication of diseased or pest-ridden trees shall apply to the Magistrate's Division of the District Court for an administrative seizure warrant to permit such activity.
