8-3-2: DEFINITIONS:
DISEASED TREE: Any tree which exhibits actual evidence of disease of whatever character or form, including infestation by pests to such a degree that it is actually affecting the tree itself.
INJURIOUS PEST: Any insect, fungus, or growing parasite which materially injures any tree or shrub.
OCCUPANT: The person actually occupying any particular property and having control over the particular property under any contractual relationship with the owner thereof.
OWNER: The vested owner of real property as shown by the County records, and any contract purchaser of real property as shown by the public records or other evidence of ownership.
PERSON: Any individual, corporation, nonprofit association or copartnership owning property.
PRUNING: The physical removal of limbs or any portion of trees or shrubbery for purposes of reducing the size of trees or shrubs, or in any way shaping the same.
PUBLIC RIGHT OF WAY: All real property owned by the City for street rights of way as indicated by the public records of Idaho County, Idaho, or any public rights of way established by prescription, pursuant to Idaho law.
TRIMMING: The trimming of trees shall mean the same as pruning. (Ord. 630, 7-15-1991)
