(a) The Health Commissioner, or his authorized representative, shall cause written notice to be served upon the owners of any suspected vicious and dangerous animal, informing them of the nature of the complaint against the animal, and the time, date, and location of a hearing to determine if the animal will be declared a vicious or dangerous animal.
(b) The Health Commissioner, or his authorized representative, shall determine whether or not to declare the animal to be a vicious and/or dangerous animal based upon evidence and testimony presented at the time of the hearing. Said evidence and testimony may be presented by the owner(s), witnesses to any incident(s) considered germane to such a determination, Health Department personnel, Animal Control personnel, police or any other person(s) possessing information pertinent to such a determination.
(c) The Health Commissioner, or his authorized representative, shall issue a written summary of a decision and order, if warranted, within forty-eight (48) hours after the hearing.
