(a) City Council may require the construction or repair of sidewalks, curbs or gutters, within the City by the owners of lots or lands abutting thereon and for such owners to bear all costs thereof, and upon the failure of such owners to construct or repair such sidewalks, curbs or gutters within the time prescribed in an ordinance adopted pursuant to Ohio R.C.729.02, may cause such sidewalks, curbs or gutters to be constructed or repaired and assess the total cost thereof against the lots or lands abutting thereon, notwithstanding the provisions of Ohio R.C. 727.03 and 727.05.
(b) Upon the filing of the report by the Director of Building and Zoning and Engineer as provided in Section 913.01 and upon approval of the City Council, the Clerk of Council shall in compliance with legislation passed by City Council, send such notices as may be required thereby. Such sidewalks not constructed, repaired or removed within the time provided by the ordinance of City Council shall be constructed, repaired or removed and paid for all as provided by such resolution of Council unless notice of request for a hearing on the matter of the necessity for construction, repair or removal is timely filed with the Clerk on or before the expiration dates as provided in such legislation, and shall be heard at the next succeeding regular Council meeting occurring ten days or more after receipt of a request for hearing by the Clerk.
(c) If any parcel, part or portion as provided in the ordinance after hearing is determined not to be necessary to be constructed, repaired or removed or court action as to any single or particular parcel or area is effected, such parcel area or particularly described portion of sidewalk may be excluded from the ordinance without invalidating the proceedings as to the remaining portions of sidewalks to be constructed, repaired or removed.
