1064.99   PENALTY; RESTITUTION.
   (a)   Failure to comply with any of the rules established in Section1064.01(a)-(g) may result in temporary or permanent removal from the Village parks. Upon the first occurrence of a violation, an individual will not be permitted to enter the Village parks for one month. Upon the second occurrence within a five year period of time, of a violation, an individual will not be permitted to enter the Village parks for one year. Any subsequent occurrence will result in an individual being permanently prohibited from entering the Village parks. Any violation of the rules staled in 1064.01 (a)-(g) shall be reviewed by the Village Prosecutor for the determination of permanent removal from the parks for these acts.
   (b)   Whoever violates or fails to comply with any of the provisions of 1064.02 through 1064.15 of this Chapter is guilty of a minor misdemeanor for the first offense and shall be fined not more than one hundred fifty dollars ($150.00). For any subsequent offense, within a five year period of time, such person is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty (30) days, or both.
   (c)   Any act of a misdemeanor crime of violence or higher will be cause for immediate and permanent removal from the Village parks. The Village Prosecutor will be given a report of such incidents and will make the final determination of the appropriate punishment for such acts.
   (d)   If a violation of any of the provisions of this Chapter results in damage or destruction of any public park property, the offender shall be liable for restitution. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
   (e)   All fines, restitution and forfeitures received and collected for violations of this Chapter shall be paid into the Village Treasury as a fund for the use of the Recreation Commission in maintaining and improving the public parks.
