1028.03   REQUIREMENTS FOR NEW WALKS.
   (a)   Statement of Need. The need is to develop a means of constructing sidewalks in areas of the Village where none exist. The specific purposes are eliminating hazards to the safety of pedestrians and providing access to schools, churches, businesses, recreation areas, etc.
   (b)   Program Requirements. The program must have the following elements:
      (1)   Criteria to identify specific areas where sidewalks are needed should be established. Possible areas are: gaps in existing sidewalks in established residential areas; business areas not now having walks along highly traveled roadways; and subdivisions and other residential developments either existing or proposed. The criteria must be objective and contain factors that can be measured and understood. Hazardous safety conditions should be identified. Abutting property owners should benefit.
      (2)   A complete survey to determine areas that need new walks, based on the criteria, should be made. The survey shall be completed by a committee consisting of members of the Sidewalk Commission and the Village Administrator or his or her designee.
      (3)   Program enforcement shall be established through adequate legislation. The legislation must be carefully prepared, given an adequate hearing for all interested parties and supported by Council after enactment.
   (c)   Program Benefits. The benefits may be obvious, if pedestrian traffic is made safer and more convenient and if better service is provided to any citizens.
