1026.17   PLANTING OR REMOVAL; PERMIT REQUIRED; REASONS FOR DENIAL.
   (a)   No person shall hereafter plant or remove any tree or shrub upon any public way, street, alley, park or other property owned or controlled by the Village, unless he or she has first obtained a permit, in writing, from the Village Administrator, specifying the size, type, species and location of such tree or shrub to be planted or removed.
   (b)   The Village Administrator may deny a permit to any person who proposes to plant any tree or shrub upon a public way, street, alley, park or other property owned or controlled by the Village of a size, type or species found to be undesirable for the location proposed, or may deny a permit to any person who proposes to plant any tree or shrub upon a public way, street, alley, park or other property owned or controlled by the Village if the location proposed for such planting is found by the Tree Commission to be unsuitable for the planting of trees or shrubs or if such planting will be otherwise incompatible with the use of said property.
   (c)   The Village Administrator may deny a permit to any person who proposes to remove any tree or shrub upon a public way, street, alley, park or other property owned or controlled by the Village when said removal will not benefit the public health, safety and welfare.
