816.02   LICENSE REQUIRED; FEES; REVOCATION.
   (a)   No person shall operate or maintain a junk yard in the Village or engage in the business of soliciting the sale or purchase of rags, papers, scrap iron, metal, junk or rubbish and refuse of any kind or description, or of collecting the same, in the Village, unless he or she first obtains a license therefor.
   (b)   The fee for such license is five hundred dollars ($500.00). All such licenses shall expire on the January 1 following the date of issuance. A license may be renewed from year to year upon paying the Clerk-Treasurer the sum of five hundred dollars ($500.00) for each renewal. All fees paid under this chapter shall be for the use of the Village.
   (c)   Any license or renewal thereof issued under this chapter may be revoked by Council, after reasonable notice and an opportunity to be heard, for a violation of this chapter by the licensee or by any of his or her officers, agents or employees. Whenever a license has been revoked, Council shall not issue another license to such licensee, to the husband or wife of such licensee or to any partnership or corporation of which he or she is an officer or member until the expiration of at least one year from the date of such revocation.
816.03   LICENSE APPLICATION AND ISSUANCE.
   (a)   An application for a license to operate and maintain a junk yard or for a renewal thereof shall be made in writing, accompanied by the proper fee, to Council, setting forth:
      (1)   The name and address of the applicant;
      (2)   The location of the junk yard;
      (3)   If the applicant is a firm, partnership or association, the names and addresses of each member;
      (4)   If the applicant is a corporation, the date and place of incorporation and the names and addresses of its officers and directors; and
      (5)   Such other reasonable information as Council deems necessary.
   The application shall be signed and sworn to by the applicant.
   (b)   All licenses shall be issued by the Mayor upon payment of the requisite fee and satisfaction of all other requirements provided in this chapter.
   (c)   No license shall be issued unless Council is satisfied as to the good character of the applicant, or if the applicant is an agent, the good character of the agent and the firm, person or corporation represented, and unless Council is satisfied that the place of storage is a proper one and will not in any way be harmful or detrimental to the health and welfare of the residents of the Village.

816.04   EXISTING ESTABLISHMENTS.
   Any person operating or maintaining a junk yard prior to the effective date of this chapter (Ordinance 686, passed March 16, 1965) is entitled to be issued a license or renewal thereof upon payment of the fee provided for in this chapter. Any person operating or maintaining a junk yard within 1,000 feet of a public street in the Village, prior to such effective date, shall have one year thereafter to erect the required fence if such junk yard is not obscured by natural objects. If, after such effective date, a junk yard is established within 1,000 feet of a public street in the Village, it shall be so located that the view thereof from such street is obscured by natural objects or by a fence. If the yard is so obscured, the person operating or maintaining such junk yard shall be entitled to a license.

816.05   FENCES.
   Any fence constructed under this chapter shall be neatly constructed, nontransparent and kept in good order and repair. No advertisement shall be permitted thereon, other than the name of the person under those name the license has been issued and the nature of the business conducted therein.

816.06   INSPECTIONS.
   (a)   Twice annually the Chief of Police shall inspect every junk yard located in the Village for which a license has been issued under this chapter, to obtain information with regard to whether or not the licensee's business has been and is being conducted in accordance with this chapter. The Chief shall submit a written report of each such examination to Council.
   (b)   The Chief shall, for purposes of such examination, have free access to the grounds and buildings used by the licensee in the conduct of the junk yard business.
   (c)   Such inspections may be made at any time, at the option of the Chief, during the regular working hours of the licensee or between 8:00 a.m. and 5:00 p.m. Monday through Friday.
