§ 92.38 PERMITTING USE OF EQUIPMENT BY OTHERS; PUNISHMENT FOR UNAUTHORIZED USE OF STREETS AND THE LIKE.
   (A)   No person or utility which has been or may be granted permission to erect or maintain in any public street, public property or public right-of-way, any poles or fixtures, conduits or cables, pipes, wires or other equipment for the distribution of its services, either above or below the ground, shall permit the equipment or fixtures to be used for any purpose by any other utility or person, without the express written consent of the city.
   (B)   Any equipment or fixture which is supported, fastened to or carried by any pole or poles, fixtures, conduits or cable, pipes, wires or other equipment in the city at the present time belonging to a person or utility which is not licensed by the city to use the public streets, public properties or public rights-of-way shall have been removed, and the violation of this provision shall have been discontinued within 90 days of the date of ratification of the ordinance from which this chapter is derived.
