It shall be unlawful for any person to place any obstruction on or in any way to obstruct any street, alley, bridge, ditch or public right-of-way; provided, that this section shall not apply to any employee of the city, county or state while the employee is immediately and actively engaged in the maintenance, improvement or construction of any street, sidewalk or public way in the city; nor to utility companies or others performing work thereon with permission from the city.
