§ 91.03 PLANTINGS PROHIBITED WITHIN THE CITY RIGHT-OF-WAY.
   (A)   Purpose. The city has identified and recognizes the risks to traffic, bicycle and pedestrian safety that may be caused by the obstructed view of all traffic forms created by the growth of vegetation or the placement of any other items in the city right-of-way that obstructs or impairs the sight lines for drivers, bicyclists and pedestrians in or about the right-of-way controlled by the city. Therefore, to promote the good and general welfare and safety of its citizens, the city, through its Council members, has determined the need to regulate the control and eradication of any nuisance within the city’s right-of-way.
   (B)   Restrictions. It shall be unlawful for any person to plant any trees or shrubs within the city right-of-way. Any other vegetation or objects planted or placed within the right-of-way that obstructs or impairs the view of any of the traffic forms as stated in division (A) above, or that interferes with the safety of residents, or is otherwise defined as a nuisance under the city’s nuisance ordinance, is also unlawful.
