(a) Whoever violates any provision of this chapter is guilty of a minor misdemeanor on the first offense. If a second offense is committed within one year after the first offense, such person is guilty of a misdemeanor of the fourth degree; each subsequent offense within one year is guilty of a misdemeanor of the third degree.
(b) Whoever violates any provision of this chapter who has been previously convicted of a violation of Ohio R.C. 2927.02 shall be guilty of a misdemeanor of the third degree.
