521.10 RECYCLING AND SOLID WASTE COLLECTION RULES.
   (a)   The owner of any property within the Village, whether residential or commercial, and/or the manager of such property shall maintain a sufficient quantity of usable garbage, trash, waste or refuse containers on site to hold a minimum of seven days garbage, trash or waste for all occupants of the premises. Such containers shall be constructed of solid materials including metal or hardened plastic and each container shall be secured by a separate lid. At anytime the garbage, trash or waste is placed in such containers the lid shall be securely in place to hold the contents therein. Any container which has deteriorated allowing its contents to leak or emit noxious odors shall be repaired or replaced by the owner/manager of the property. Garbage, trash, waste or refuse may not be stored outside of such containers in any cardboard container or plastic or paper bag as these materials tend to deteriorate and are easily ripped or torn by animals.
 
   (b)   Recycling materials is defined as any materials removed from the solid waste stream for the purposes of reprocessing and/or reuse which include, but are not limited to, newsprint, glass, metal and plastics. Recycling materials shall be stored on the property in an appropriate recycling container provided by the Collection Agent for the property. If not stored in the appropriate container provided by the Collection Agent, such recyclable materials must be appropriately secured so as not to cause waste or litter upon the property.
 
   (c)   The owner, tenant, agent, lessee, occupant or person in charge of any premises, residential or commercial, shall properly store all containers, when not set-out for waste collection, so as to be accessible by all occupants of the premises, and such container shall not be readily visible from the street and shall not be stored or placed in such a way to create a nuisance to neighbors.
 
   (d)   No garbage, trash, refuse or waste shall accumulate on the premises without being properly stored in waste containers as set forth in this section.
 
   (e)   No garbage, trash or refuse containers or recycling containers shall be set-out on the curbside sooner than 6:00 p.m. the day before waste collection for the date scheduled for waste collection between the property owner and the Collection Agency for such property. All garbage, trash, waste, refuse containers or recycling containers shall be returned to storage in accordance with this section no later than 11:59 p.m. the day of collection scheduled between the property owner and the Collection Agent.
 
   (f)   Whoever violates any section of this section is guilty of a misdemeanor punishable by a fine of no more than one hundred dollars ($100.00) for the first offense and no more than two hundred fifty dollars ($250.00) for any subsequent offense within one year. Each separate day a violation occurs may be charged as a separate offense.
