Whoever violates any provisions of this Chapter shall be guilty of a minor misdemeanor with a fine of up to one hundred fifty dollars ($150.00). Should the person be found guilty of a second offense for violating this Chapter within twelve (12) months of the first offense, such person shall be guilty of a fourth degree misdemeanor with a fine of up to two hundred fifty dollars ($250.00) and/or a term of imprisonment not exceeding thirty (30) days. Should the person be found guilty of a third offense for a violation of this Chapter within twelve (12) months of the first offense, such person shall be guilty of a third degree misdemeanor with a fine of up to five hundred dollars ($500.00) and/or a term of imprisonment not exceeding sixty (60) days. Should the person be found guilty of a fourth offense for a violation of this Chapter within twelve (12) months of the first offense, such person shall be guilty of a second degree misdemeanor with a fine of up to seven hundred fifty dollars ($750.00) and/or a term of imprisonment not exceeding ninety (90) days. Should the person be found guilty of a fifth or more offense for a violation of this Chapter within twelve (12) months of the first offense, such person shall be guilty of a first degree misdemeanor with a fine of up to one thousand dollars ($1,000) and/or a term of imprisonment not exceeding one hundred eighty (180) days. Each day a violation continues after appropriate Notice has been served shall be deemed a separate offense.
