533.16 SEX OFFENDERS RESIDENCY RESTRICTIONS.
   (a)   Unless otherwise authorized by law, no person who has been convicted of, has pleaded guilty to, or pleads guilty to either a sexually oriented offense as defined by Ohio law that is not a registration-exempt sexually oriented offense or a child-victim oriented offense as defined by Ohio Law and who under Ohio R.C. 2950.04 must report his or her residence according to law shall establish a residence or occupy any residential premises within one thousand (1000) feet of school premises, any day care facility premises, playground premises, park premises, swimming pool premises, athletic field premises, and church premises. The one thousand (1000) foot limitation shall be measured from the nearest property line of the residential premises occupied to the nearest property line of the school, daycare facility, playground, park, library, swimming pool, church, or non-school athletic field premises.
   (b)   A schedule of those premises that constitute a school, daycare facility premises, playground premises, park premises, swimming pool premises, athletic field premises, or church premises in Village of Golf Manor shall be maintained by the Village Police Department, and such schedule shall be made available upon request by any individual.
   (c)   If a person to whom subsection (a) hereof applies violates subsection (a) by establishing a residence or occupying a residential premises within one thousand (1000) feet of any of the restricted locations mentioned in subsection (a) hereof, the Solicitor or designee, following authorization by Council, may bring an action for equitable relief, including injunctive relief, in a court of appropriate jurisdiction against such person to enforce the terms of this section. In addition, a violation of subsection (a) hereof may be prosecuted as a misdemeanor of the first degree, punishable by a fine up to the amount of one thousand dollars ($1,000) and up to six (6) months in jail. Each day a person violates subsection (a) hereof shall be considered a separate violation.
   (d)   No action for equitable relief nor any criminal citation may be brought against any person who, prior to the passage of this section, has established a residence that is otherwise legal under Ohio R.C. 2950.031 by virtue of a Rental Agreement consisting of a Lease of residential premises for a term exceeding thirty (30) days until such Rental Agreement or Lease expires.
