(a) It shall be unlawful for any person to drop, throw, place or allow to accumulate any grass, shrubbery, tree clippings or dead leaves which may damage or injure any person, or impact safe travel by any vehicle or person traveling along or upon any street or alleyway within the Village.
(b) Any person who drops or permits to be dropped or thrown upon any street or alleyway within the Village those materials defined in subsection (a) above shall immediately remove the same.
(c) Whoever violates any provision of subsections (a) or (b) of this section is guilty of a minor misdemeanor for a first offense within a twelve (12) month period. If such offender is convicted of or pleads guilty to a second offense under this section within a twelve (12) month period, then whoever violates any provisions of subsection (a) or (b) of this section is guilty of a misdemeanor of the fourth degree. If such offender is convicted of or pleads guilty to a third or more offense under this section within a twelve (12) month period, then whoever violates any provisions of subsection (a) or (b) of this section is guilty of a misdemeanor of the third degree.
